Without comment: The Oscar Pistorius affidavit

Charged with murder: Oscar Pretorius

Barry Roux, the advocate for Oscar Pistorius, read this 10-page statement to the court in Pretoria today, while girlfriend Reeva Steenkamp, shot four times at Oscar's home on Valentine's Day, was being laid to rest in Port Elizabeth.
Last year, Oscar - still just 25 - became the first amputee to run in the Olympics at the summer games in London.
His application for bail on a charge of murder will continue tomorrow.

"I deny the aforesaid allegation in the strongest terms.

"On 13 February, Reeva would have gone out with her friends and I with my friends.

"Reeva then called me and asked that we rather spend the evening at home.

"I agreed and we were content to have a quiet dinner together at home.

"By about 10pm on 13 February 2013, we were in our bedroom. She was doing her yoga exercises and I was in bed watching television.

"My prosthetic legs were off. We were deeply in love and I could not be happier. I know she felt the same way.

"She had given me a present for Valentine's Day, but asked me only to open it the next day."


"I am acutely aware of violent crime being committed by intruders entering homes with a view to commit crime, including violent crime. I have received death threats before. I have also been a victim of violence and of burglary before.

"For that reason, I kept my firearm, a 9mm Parabellum, underneath my bed when I went to bed at night.

"During the early hours of 14 February, 2013, I woke up, went onto the balcony to bring the fan in and close the sliding door, the blinds and the curtains.

"I heard a noise in the bathroom and realised that someone was in the bathroom. I felt a sense of terror rushing over me.

"There are no burglar bars across the bathroom window and I knew that contractors who worked at my house had left the ladders outside.

"Although I did not have my prosthetic legs on I have mobility on my stumps.

"I believed that someone had entered my house. I was too scared to switch a light on. I grabbed my 9mm pistol from underneath my bed.

"On my way to the bathroom, I screamed words to the effect for him/them to get out of my house and for Reeva to phone the police.

"It was pitch dark in the bedroom and I thought Reeva was in bed. I noticed that the bathroom window was open. I realised that the intruder/s was/were in the toilet because the toilet door was closed and I did not see anyone in the bathroom.

"I heard movement inside the toilet. The toilet is inside the bathroom and has a separate door.

"It filled me with horror and fear of an intruder or intruders being inside the toilet.

"I thought he or they must have entered through the unprotected window.

"As I did not have my prosthetic legs on and felt extremely vulnerable, I knew I had to protect Reeva and myself.

"I believed that when the intruder/s came out of the toilet we would be in grave danger.

"I felt trapped as my bedroom door was locked and I have limited mobility on my stumps.

"I fired shots at the toilet door and shouted to Reeva to phone the police.

"She did not respond and I moved backwards out of the bathroom, keeping my eyes on the bathroom entrance.

"Everything was pitch dark in the bedroom and I was still too scared to switch on a light. Reeva was not responding.

"When I reached the bed, I realised that Reeva was not in bed.

"That is when it dawned on me that it could have been Reeva who was in the toilet.

"I returned to the bathroom calling her name. I tried to open the toilet door but it was locked. I rushed back into the bedroom and opened the sliding door, exiting onto the balcony and screamed for help.

"I put on my prosthetic legs, ran back to the bathroom and tried to kick the toilet door open.

"I think I must then have turned on the lights.

"I went back into the bedroom and grabbed my cricket bat to bash open the toilet door. A panel or panels broke off and I found the key on the floor and unlocked and opened the door.

"Reeva was slumped over but alive.

"I battled to get her out of the toilet and pulled her into the bathroom.

"I phoned Johan Stander who was involved in the administration of the estate and asked him to phone the ambulance. I phoned Netcare and asked for help.

"I went downstairs to open the front door. I returned to the bathroom and picked Reeva up as I had been told not to wait for the paramedics, but to take her to hospital.

"I carried her downstairs in order to take her to the hospital. On my way down, Stander arrived. A doctor who lives in the complex also arrived.

"Downstairs, I tried to render the assistance to Reeva that I could, but she died in my arms.

"I am absolutely mortified by the events and the devastating loss of my beloved Reeva.

"With the benefit of hindsight I believe that Reeva went to the toilet when I went out onto the balcony to bring the fan in.

"I cannot bear to think of the suffering I have caused her and her family, knowing how much she was loved.

"I also know that the events of that tragic night were as I have described them and that in due course I have no doubt the police and expert investigators will bear this out."

  1. So so sad, but not a true statement! If you share a bed, why would she lock the toiletdoor! Blinds and curtains were open and he couldn't see that she was no longer in bed????? He screamed that the intrudors must leave his property, why did Reeva then not answer from behind the closed toiletdoor??? When the first bullet hit the target, surely there must have been screams from within the toilet. What about the sms from Hougaard and the fighting which was reported by neighbours at 21.30?? No our goldenboy, its time to admit the truth!

  2. I'm constantly getting up to pee in the night and my Mrs, although alseep knows this is the case. When you share a bed with someone you are connected. How could he not realise that she wasn't in the toilet? This guy has always been a miserable individual who perhaps was always on the path to destruction ever since he first shot to fame. I say lock him up in some hot languid gaol with no blades and no prosthetics for the rest of his life on bread and warm water.

    Also strip him of his wealth and sponsership money and give it to the poor and needy

  6. Things to ponder on:
    1) It was pitch dark in the room. There is no mention of any difficulty in him moving around and locating his gun, so one can assume this happened quite quickly and effortlessly.
    2) He approached the bed to retrieve his gun, now depending on which side he slept, the side closest to the sliding door, he would retrieve the gun and walk past the foot of the bed. If he slept on the furthest side, he to, would have had to walk past the foot of the bed. He didn't notice she was not in the bed.
    3) Instead of waking her up quietly informing her that there are intruder/as in the house, and telling her to phone the police, or for that matter, the security guards, that's much closer and would be quicker to respond. He instead walks to the bathroom then screams at the intruder/a to leave his house and for her to phone police. She didn't respond.
    4) He had enough time to realise the window was open, notice in the pitch dark room that the bathroom was empty as well as the toilet door being closed. In all this time there wasn't no response from her and yet he discharges his weapon four times into the toilet door and once again shouted for her to phone the police. Even after 4 extremely loud gun shot sounds, she didn't respond. Only then did he check up and made sure she is ok.
    5) Was the lights in the bathroom on? He mentions only that the lights in the bedroom was and it was still pitch dark (seems to want to emphasise the fact that he could not see in the bedroom) off and was still to scared to switch it on. Do intruders break in and switch the lights on? If so would this not have woken him up earlier?
    6) Only upon reaching the bed the second time, the first being the gun retrieval and the second checking up on her, did he realise she was not in bed.
    7) At some point the bedroom lights was turned on, no mention of bathroom lights being turned on.
    8) Where is the bathroom light switch situated? Very relevant as to how the would be intruders switched the light on without him realising it. Maybe he sleeps with lights on, irrelevant then.
    9) After breaking down the door he battled to get her out of the toilet. Did the police take into consideration the position of the toilet seat cover? Relevant as to someone doing their business and someone sitting on the toilet hiding away. Blood spatter will also be very different in both scenarios.
    10) Was the toilet tested for waste products and urine, also relevant as to prove disprove claim she was in toilet doing her business.

    There seems to be many loopholes and inconsistencies in this story. I find it hard to believe that this is the best defence his his dream team of experts has come up with.

    If a nobody like me can raise questions, and see importance in small but relevant flaws in their defence, I can but only hope the experts has got slot more up their sleeves and get to the truth of what happened that night. I simply hope the defence of I am rich, white, famous and to top it off, disabled defenses of So What gets what is coming to him. If he is not guilty of premeditated murder, he is surely still guilty of murder and that makes him murderer.

    If there was an intruder everyone would have hailed him a victim even though he still would have shot and killed a person in cold blood. This is the life of the rich and famous anyone else well gets crucified.

    I wait in an anticipation for the technicality that will make him walk free and carry on with his life as if nothing happened.

  7. YOU SAY YOU SAW THAT THE BATHROOM WINDOW WAS OPEN AND THE DOOR WAS LOCKED? HOW DARK IS DARK? CLEARLY HE NEVER PASSED HIS GUN LICENSE EXAM! OSCAR, YOU THREW 30 YEARS OF A BRIGHT AND BEAUTIFUL PERSONS LIFE INTO THE DUSTBIN!

  9. To be honest .. I find this very hard to believe.
    I have agree with everything that 'anonymous' @ 19:57 has stated in his/her post. Pretty much sums up the questions I've been asking myself.

    To many inconsistencies and loopholes in Oscar's "story".

  14. Had a really lucky escape whilst burgling a house last week in Pretoria.

    I got nervous and was having a shit when this stunning woman walked in.

    I'm sure I heard gunshots as I hopped out the window!!!
